Our litigation department has extensive experience in litigating real property disputes on a wide variety of issues. These matters include zoning and other land use matters, ownership rights disputes, real estate finance issues and environmental issues. Our clients include some of Israel’s largest developers, as well as major international companies with real property interests in Israel.
The firm’s real estate litigation practice is headed by Amos Goren, one of Israel’s most experienced litigators in real property matters. Amos has represented some of Israel’s largest developers as well as various public authorities in commercial, regulatory and environmental matters arising out of real property development projects.
Representative experience:
- Representation of the US State Department in an administrative petition against building the American Consulate Project in the Arnona neighborhood in Jerusalem.
- Defense of Yakum Pituach (of Fishman Holdings Group) in an objection to an administrative petition and an appeal to the high court regarding the legality of establishing and operating the Europark industrial park in Yakum. The high court ruled in favor of our client setting a precedent regarding the subject of laches in administrative law.
- Representation of Oneal Construction (of Fishman Holdings Group) in a damages claim against the Israel Land Administration and the Municipality of Tel Aviv due for causing delays in building and marketing the prestigious Rova Lev Ha'ir Project in Tel Aviv.
- Representation of the General Custodian of the State of Israel, as manager of assets of scores of missing persons who had purchased lands in the Jezreel Valley almost a century ago, and of the liquidator of the Community of American Zionists Company, who dealt with land redemption against Moshav Balfouria concerning control of over one million square meters of valuable land.
- Representation of the Hachamov Brothers Group and others in a dispute over control, management and rights in the group of companies that deal with real estate, in a series of arbitration and court proceedings.
- Representation of firms under the control of foreign investors, in derivative claims in multiple venues, in order to block a takeover attempt on a prestigious real estate complex in the center of Jerusalem.
